United States Judge Reggie Walton denied ISIS bride Hoda Muthana’s petition for an expedited hearing to consider her request to return to the United States during a hearing on March 4, 2019 at 11:00 am.
Judge Walton denied her family’s request to expedite their suit, saying their argument that she could get stuck in Syria or put in danger if American troops pull out involved too much speculation. “The case will need to adhere to the normal course of the flow of litigation” and “proceed on the normal track,” Walton said.
Florida Family Association sent out two alerts prior to the March 4, 2019 hearing that encouraged thousands of people to send emails to urge Judge Walton to make national security and public safety the priority in Muthana v. Pompeo.
The Constitutional Law Center for Muslims in America is representing three time ISIS bride Hoda Muthana’s demand that she be allowed to return to the United States after she:
• Married THREE ISIS commandos. Hoda was so dedicated to the Caliphate’s war against the United States that she married two more ISIS militants after the first husband was killed in battle.
• Called for broad random killing of Americans. “Go on drive-bys and spill all of their blood, or rent a big truck and drive all over them. Veterans, Patriot, Memorial etc Day parades..go on drive by’s + spill all of their blood or rent a big truck n drive all over them. Kill them,” Muthana tweeted from her now-suspended Twitter account, according to a profile of her by BuzzFeed News.
Hoda Muthana says that she has realized that she made a “big mistake” and wants to return to the U.S. with her 18-month-old son. The attorney for Muthana has said that when she joined the terrorist organization, she was a “naive very foolish young woman” and was “manipulated, raped and brain washed.”
Muthana and her attorney’s representations do not add up. How can she call three consecutive marriages to three ISIS militants a “mistake” or claim that she was manipulated. Additionally, the Islamic rule, Iddah, requires widows to wait four months before remarrying. That means that Hoda Muthana had a total of eight months to reconsider her situation before remarrying or trying to reenter the United States. She only wants to return to the United States because the ISIS run Caliphate has been decimated and there are no more top Caliphate commanders worth marrying.
Secretary of State Mike Pompeo, has declared that Muthana was never actually a US citizen — and that, therefore, there’s no legal obligation for the US to take her back, even if it’s to put her on trial.
Muthana’s father, Ahmed Ali Muthana, is suing to allow her to come home, claiming that both she and her 18-month-old son are in fact US citizens and that they are being deprived of their constitutional rights.
Muthana was issued a passport as a US citizen. But the government challenged her citizenship before giving her a passport. In 2016, after she’d burned her passport upon joining ISIS — “Bonfire soon, no need for these anymore, alhamdulliah [thanks be to God],” she tweeted, with a photo of her and several other women’s Western passports — the Obama administration officially declared the passport and her citizenship had never been valid to begin with.
How do we know three time ISIS bride Hoda Muthana isn’t still working for the group? If she is allowed back in the United States, Hoda will have to stand trial for supporting ISIS. How much more will she hate America for prosecuting her and what will she do while waiting for trail? And how much will it cost taxpayers to prosecute a foreign combatant?
District Judge Reggie B. Walton, U.S. District Court, District of Columbia, ordered on February 26, 2019 “that the parties shall appear before the Court for a hearing on the plaintiff's Expedited Complaint for Declaratory Judgment, Injunctive Relief and Petition for Writ of Mandamus on March 4, 2019, at 11:00 a.m.”
