The Council On American Islamic Relations (CAIR) LOST its law suit which challenged the constitutionality of the United States Terror Watchlist. CAIR sued the Department of Homeland Security (DHS) on April 5, 2016 on behalf of 23 Muslims. The lawsuit challenged the validity of the Terror Screening Database (TSDB), the official name for the Terror Watchlist that is used by law enforcement and the private sector to protect millions of Americans and the citizens of several other countries from terrorism. Florida Family Association launched numerous online campaigns that asked people to send emails that encouraged the district court judge and appellate court justices to make national security the priority in this case. On May 28, 2021, the full U.S. Court of Appeals for the Fourth Circuit issued the final ruling on the case which upheld the Terror Watch list as constitutional.
However, the fact that the federal courts have upheld the Terror Watchlist has not stopped CAIR from challenging the use of the list by law enforcement agencies for public safety.
Terror linked CAIR published an article titled “CAIR-OK, CAIR LDF Welcome OKC Police’s Decision to Instruct its Officers to Disregard FBI Watchlist.” The article reports in part:
(WASHINGTON, D.C., 2/2/2023) – The Oklahoma chapter of the Council on American-Islamic Relations (CAIR-OK) and the CAIR Legal Defense Fund (CAIR LDF) today welcomed the Oklahoma City Police Department’s (OKCPD) actions since last week’s filing of a lawsuit against the department for its targeting of American Muslim Air Force veteran Saadiq Long based solely on his name being unlawfully included on a federal terror watchlist.
In a stipulation filed with the Oklahoma City federal court yesterday, the Oklahoma City Police Department acknowledged that “neither Saadiq Long nor any other person should be stopped by officers based solely on that individual’s” status on the FBI’s watchlist.
The wording in the affidavit stating “based solely on that individual’s status on the FBI watch list” appears to mean that the police department may still use the watch list in conjunction with “other” law enforcement intelligence. However, the heading of CAIR’s press release states that “OKC Police’s Decision to Instruct its Officers to Disregard FBI Watchlist.”
CAIR is an unindicted co-conspirator in the 2009 Holy Land Foundation (HLF) retrial, the largest terrorism financing case in American history. In November 2014, the United Arab Emirates designated CAIR as a terrorist organization.
CAIR has not found a law enforcement tool or statute that is designed to fight terror that ii likes and will not challenge.
